These Vendor Terms govern your use of the FarmForYou marketplace platform to list, market, sell, and fulfill products to buyers. By creating a vendor account you agree to these terms.
Vendors are independent businesses. Nothing in these terms creates an employment, agency, franchise, or partnership relationship. You are solely responsible for your own operations, employees, taxes, insurance, permits, and legal compliance.
You must be at least 18 years old and have authority to bind your business to these terms. You must provide accurate business information and promptly update any changes.
You are responsible for maintaining secure credentials, all activity under your account, providing accurate tax and payout information, and responding promptly to buyer inquiries. Identity verification, documentation, or licensing may be required.
You may only list lawful products consistent with FarmForYou policies. All listings must be accurate, truthful, non-misleading, properly priced, in stock, compliant with labeling requirements, and you must have rights to all listing content. FarmForYou may remove, suspend, reject, or edit listings at its discretion.
You are solely responsible for compliance with all applicable food safety laws, cottage food laws, agricultural regulations, organic claim rules, labeling requirements, expiration dating, temperature control, recalls, and all applicable local, state, and federal licensing. FarmForYou does not inspect, certify, manufacture, or store products.
You are responsible for fulfilling orders accurately and on time, including product availability, substitutions, packaging, pickup readiness, delivery handoff, and quality. Repeated late fulfillments, cancellations, or buyer complaints may result in penalties or account suspension.
You control your own pricing unless participating in promotional programs. You are responsible for honoring your posted prices, except in the case of obvious technical errors.
FarmForYou may charge marketplace commissions, payment processing fees, subscription fees, advertising fees, delivery coordination fees, and chargeback or dispute recovery fees. Current fees are disclosed in your vendor dashboard and pricing schedule. Fees may be modified with reasonable notice.
Payments are processed through Stripe. By using FarmForYou you authorize us to collect payments, deduct applicable fees, issue refunds where appropriate, hold reserves for fraud or dispute risk, and delay payouts for compliance reasons. Payout timing is estimated and not guaranteed.
You are solely responsible for your own income, sales (except where marketplace facilitator laws require FarmForYou to collect and remit), employment, and other applicable taxes.
Customer information may only be used for order fulfillment and support. You may not sell customer data, add customers to marketing lists without consent, or circumvent the platform to move transactions off FarmForYou.
You retain ownership of your trademarks and logos. You grant FarmForYou a non-exclusive, worldwide, royalty-free license to use your content for operating the platform, search results, marketing, and analytics. You warrant that you have the rights to grant this license.
Vendors may not sell unlawful or counterfeit goods, misrepresent product origin or quality, manipulate reviews, interfere with platform operations, circumvent fees, abuse promotions, or harass or discriminate against buyers.
FarmForYou may suspend or terminate vendor accounts immediately for safety concerns, fraud, legal compliance, excessive chargebacks or complaints, policy violations, inactivity, or reputational risk. Vendors may stop using the platform at any time subject to completing outstanding orders and settling payments.
The FarmForYou platform is provided AS IS and AS AVAILABLE without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted service.
FarmForYou is not liable for indirect, incidental, special, consequential, or punitive damages. Aggregate liability is capped at the greater of fees paid in the prior three months or $250 USD.
You agree to defend and indemnify FarmForYou and its affiliates from claims, damages, or losses arising from your products, food safety issues, regulatory violations, taxes, intellectual property infringement, or your breach of these terms.
These terms are governed by Colorado law. Disputes are resolved by binding individual arbitration in Colorado. Class actions and jury trials are not permitted. Either party may seek temporary injunctive relief for intellectual property misuse or emergency equitable relief.
FarmForYou may update these Vendor Terms at any time. Material changes will be communicated via the platform, email, or your vendor dashboard. Continued use constitutes acceptance.
